Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and IOK Labs Inc. ("KYN AI", "we", "us", or "our") and govern your use of the KYN AI mobile application, the KYN AI companion app for ChatGPT, and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

KYN AI is an independent application that helps Sweat & Tonic ("S&T") members understand their class history and book classes with less friction by connecting to their studio's booking platform (MarianaTek) on their behalf. KYN AI is provided by IOK Labs Inc. and is not operated, endorsed, or managed by Sweat & Tonic, Apple, or Google.

2. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service. Member features require a valid Sweat & Tonic / MarianaTek membership in good standing.

3. Your Account and Member Credentials

You are responsible for maintaining the confidentiality of your account and for all activity under it. You authorize KYN AI to access your studio membership and to read your bookings and history in order to provide the Service. You must provide accurate information and promptly update it as needed.

4. Bookings, Cancellations, and Auto-Booking

KYN AI acts as a convenience layer that books, swaps, cancels, and auto-books classes on your behalf at your studio. KYN AI is not the studio and does not control class availability, schedules, pricing, waitlists, or studio policies.

  • You remain fully responsible for your studio's booking, cancellation, late-cancellation, and no-show policies, and for any fees, charges, or penalties that result from bookings or cancellations made through the Service.
  • When you enable auto-booking, you authorize KYN AI to place bookings automatically according to your settings. You are responsible for reviewing and confirming your auto-booking plans and for any resulting reservations or charges.
  • We do not guarantee that any class can be booked, that a spot will be available, or that a booking or cancellation will succeed.

5. AI Features and Health Disclaimer

The Service uses AI to generate recommendations and to power an in-app companion. Recommendations and AI responses are provided for convenience and informational purposes only and do not constitute medical, health, fitness, or professional advice. Always consult a qualified professional before making decisions about exercise or health. You use the Service and participate in any physical activity at your own risk.

6. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of your studio's terms;
  • access another person's account or membership without authorization;
  • interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service or its systems;
  • use automated means to abuse booking systems or circumvent studio policies.

7. Payments and Subscriptions

KYN AI does not currently charge you through the app for membership; your membership and class billing are handled by your studio through its booking platform. If we offer paid in-app features or subscriptions in the future, they will be billed through the applicable app store and governed by that store's terms, including any auto-renewal terms disclosed at purchase.

8. Intellectual Property

The Service, including its software, design, and content, is owned by IOK Labs Inc. and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All trademarks are the property of their respective owners.

9. Third-Party Services

The Service relies on third parties (including MarianaTek, Google, Apple, and AI service providers). Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, or availability.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT BOOKINGS WILL ALWAYS SUCCEED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IOK LABS INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM MISSED, FAILED, OR UNWANTED BOOKINGS OR CANCELLATIONS, STUDIO FEES OR PENALTIES, OR LOSS OF DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE PRIOR 12 MONTHS OR CAD $50.

12. Indemnification

You agree to indemnify and hold harmless IOK Labs Inc. from any claims, losses, or expenses arising out of your use of the Service or your violation of these Terms.

13. Termination

You may stop using the Service and disconnect your membership at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in Ontario, Canada, unless otherwise required by applicable law.

15. Apple App Store — Additional Terms

If you obtained the app from the Apple App Store, the following also apply:

  • These Terms are between you and IOK Labs Inc. only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • To the extent of any applicable warranty, in the event of failure to conform, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or third parties relating to the app, including product-liability, legal-compliance, or consumer-protection claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Google Play — Additional Terms

If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app or its content.

17. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance.
